Judge Sonia Sotomayor could walk into a firestorm on Capitol Hill over her stance on gun rights, with conservatives beginning to question some controversial positions she's taken over the past several years on the Second Amendment.

Earlier this year, President Obama's Supreme Court nominee joined an opinion with the 2nd Circuit Court of Appeals ruling that Second Amendment rights do not apply to the states.

A 2004 opinion she joined also cited as precedent that "the right to possess a gun is clearly not a fundamental right." link

Face it, she's going to be sitting on the court unless, god forbid, she gets hit by a bus or something. Really it's a wash anyway. One liberal activist for another.

Yeah, but that makes it close to a 50/50 split. I'd much prefer a majority of strict constructionist judges, ones who follow the literal meaning of the constitution. Big Grin

Oooh, how radical she is!  Alot of politicians from both parties agree with the majority of her decisions.  I've heard many say so publicly on tv and the web. 

Granted, she's not an old white male, but that's a different argument and rationale.Wink

So, I may agree with one or more of her decisions.  However, her guns rights views and association with a, lawless-oriented, Hispanic immigration reform group show a disregard for the Constitution.   While it is a trade off for one liberal judge for another, we really need justices who rule by the Constitution.

I contend Sotomayor's position, in which she states the right to bear arms is NOT a fundamental right, is very radical. According to the recent SCOTUS decision in the Heller case, the individual right to keep and bear arms was affirmed.

"Our founding fathers wrote and intended the Second Amendment to be an individual right. The Supreme Court has now acknowledged it. The Second Amendment as an individual right now becomes a real permanent part of American Constitutional law." link

Only a radical activist judge would contend that this right doesn't extend to the states, which is what Sotomayor has said. I'll be willing to wager that 90%+ of the American people would agree that the right to keep and bear arms is a fundamental right guaranteed to all citizens under the constitution, and now SCOTUS has said as much.

Yes, her position is very radical in this instance.

Her racist statement in which she suggested that a person of one ethnic group and gender would be able to render a BETTER decision than a person of another ethnic group and gender is also a very radical position. I feel she should be excluded from consideration because of that statement alone.

It was interesting to see her "confirmation conversion" from a radical left-wing activist judge to a strict constructionist. Roll Eyes

Personally, I think she was being dishonest and simply saying whatever it took to get confirmed. In simple terms, I believe her to be a liar and given that, not fit to be a member of SCOTUS.

Wonder why this is not considered Settled Law? She proclaimed the Abortion issue Settled Law. What criteria has to be met for an issue to be Settled?

Anyone check if she has security yet?
